there is no type of plant called "vegetable." Vegetables mean the sort of plants we eat with the main course of the dinner, not for desert.
The United States Supreme Court ruled that it is a fruit botantically and a vegetable in common speech, and the law distinguishing between fruits and vegetables was using the ordinary meaning.

Pizza sauce is a vegetable? It sound more like a sauce to me.
Err, I din't know about the Supreme Court sayiing that. Instead we have the reasoning that tomatoes are fruits because they cntain the seeds.

The Supreme Court would have had difficulty leaving it to the FDA which had not been created when it ruled. (IIRC.) Besides, the FDA certainly doesn't handle custom duties.

containing seeds does not make a fruit a berry. containing seeds is what makes a berry a fruit. The difference between most vegetables and fruits is that vegetables depend on root propagation and shoot growth (when a chunk of the plant falls off and then grows into a new plant) to reproduce. Fruit depends on the spread of its seeds to reproduce. Whether the seeds fall off the outside (like on strawberries) or as their eaten animals deposit the seeds elsewhere (like apples) or the wind carries the seeds off the trees and plants them elsewhere (i believe this is true for bananas). I'm pretty sure I'm more than 90% accurate but if you're really curious you should look it up!
